1. Acceptance of Terms

By accessing or using the EXATEC Australia Connect platform (“Platform”), operated by EXATEC Australia (“we”, “our”, or “us”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, please do not use the Platform.

2. Eligibility

The Platform is exclusively for alumni of Tecnológico de Monterrey (Tec de Monterrey) who are living in, planning to move to, or have a connection with Australia. By registering, you represent and warrant that:

  • You are at least 18 years of age
  • You are a legitimate alumnus of Tec de Monterrey
  • All information you provide is accurate and truthful
  • You will maintain the accuracy of your information

3. Account Registration & Verification

3.1 Registration

To access member features, you must create an account by providing accurate information including your name, email, and Tec de Monterrey academic credentials (matrícula, campus, degree, graduation year).

3.2 Verification Process

All new accounts are subject to verification by our administrators to confirm your alumni status. Until verified, your access to certain features (directory, events, announcements) will be limited. We reserve the right to reject applications that cannot be verified or that we reasonably believe to be fraudulent.

3.3 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorised use.

4. User Conduct

You agree not to:

  • Provide false or misleading information about your identity or alumni status
  • Use the Platform for commercial solicitation, spam, or advertising without authorisation
  • Harass, abuse, or harm other members
  • Share other members’ private contact information without their consent
  • Post content that is offensive, discriminatory, defamatory, or illegal
  • Attempt to gain unauthorised access to other accounts or Platform systems
  • Use automated tools to scrape or collect member data
  • Violate any applicable laws or regulations

5. Member Directory

The member directory is provided to facilitate networking among verified EXATEC alumni. By using the directory, you agree to:

  • Use contact information only for legitimate networking purposes
  • Respect other members’ privacy settings and preferences
  • Not share or export directory data for commercial purposes
  • Not use the directory to send unsolicited bulk communications

6. Events

6.1 Event Participation

Events organised through the Platform are community activities. By RSVPing to an event, you commit to attending in good faith. Repeated no-shows may result in restricted access to future events.

6.2 Event Content

Photos and content shared at events may be used for community communications and social media. If you do not wish to be photographed, please inform the event organisers.

6.3 Liability

EXATEC Australia facilitates community events but is not liable for any injuries, damages, or losses that may occur during events. Participants attend at their own risk.

7. User Content

By submitting content to the Platform (including profile information, photos, feedback, and announcements), you grant EXATEC Australia a non-exclusive, royalty-free licence to use, display, and distribute such content for Platform operations and community communications.

You represent that you own or have the necessary rights to share any content you submit, and that such content does not violate any third-party rights.

8. Intellectual Property

The Platform, including its design, features, and content (excluding user-generated content), is owned by EXATEC Australia and protected by intellectual property laws. You may not copy, modify, or distribute Platform materials without our permission.

“EXATEC” and “Tec de Monterrey” are trademarks of Tecnológico de Monterrey. EXATEC Australia is an independent alumni community and is not officially affiliated with Tecnológico de Monterrey.

9. Privacy

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your personal information.

10. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms or engage in conduct that we deem harmful to the community. You may also request to delete your account at any time by contacting us.

11. Disclaimers

The Platform is provided “as is” without warranties of any kind. We do not guarantee that the Platform will be uninterrupted, error-free, or secure. We are not responsible for the accuracy of information provided by other members.

EXATEC Australia is a volunteer-run community organisation. We do not provide professional advice (legal, immigration, career, etc.) and any information shared through the Platform should not be considered as such.

12. Limitation of Liability

To the maximum extent permitted by law, EXATEC Australia and its volunteers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.

13. Indemnification

You agree to indemnify and hold harmless EXATEC Australia and its volunteers from any claims, damages, or expenses arising from your violation of these Terms or your use of the Platform.

14. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated through the Platform or via email. Your continued use of the Platform after changes constitutes acceptance of the modified Terms.

15. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms or your use of the Platform shall be resolved in the courts of New South Wales.
